Terms and Conditions

Last updated: October 18, 2026.

These Terms and Conditions govern access to and use of the website afcitsolutions.com (the “Website”), owned by AFC IT Solutions. By browsing the Website you accept these conditions; if you do not agree, please do not use it.

1. Purpose

The Website provides information about AFC IT Solutions’ software development, design, web and mobile applications, e-commerce, consulting and systems integration services, and allows you to contact us.

2. Use of the Website

You agree to use the Website lawfully, in good faith and without infringing third-party rights. In particular, you may not:

  • Introduce viruses or malicious code, or attempt unauthorised access to systems or data.
  • Send spam, unlawful content or false information through the contact form.
  • Mass-extract or automatically harvest content or data from the Website (scraping) without our authorisation.
  • Use the Website for purposes contrary to the law or to these conditions.

3. Services, quotes and contracting

The information on the Website is for guidance only and does not constitute a binding offer. The provision of any service will be formalised through an accepted quote or a specific contract, which will set out scope, deadlines, price, payment terms and ownership of deliverables. In case of conflict, what is agreed in that document prevails.

4. Intellectual and industrial property

The texts, designs, logos, images, code and other content of the Website, as well as the brand and trade name AFC IT Solutions, belong to their owner or are used under licence, and are protected by the intellectual and industrial property laws of Ecuador and Spain. Reproduction, distribution or modification without prior written authorisation is prohibited, except as permitted by law. The trademarks and logos of clients shown on the Website belong to their respective owners.

5. Third-party links and content

The Website may contain links or embedded content from third parties (for example, maps). We do not control and are not responsible for their content, policies or availability.

6. Availability and limitation of liability

We strive to keep the Website available and up to date, but we do not guarantee the absence of interruptions or errors. To the extent permitted by law, AFC IT Solutions is not liable for damages arising from use of the Website, inability to access it or decisions taken on the basis of its information. This limitation does not affect rights that the law grants to consumers and that cannot be excluded, nor liability for wilful misconduct or gross negligence.

7. Consumers and users

If you are a consumer, the non-waivable rights of Ecuador’s Organic Law on Consumer Protection or, if you live in Spain, of the Consolidated Text of the General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007) apply to you, together with any applicable European Union rules. You may send us any complaint through the contact form.

8. Data protection and cookies

The processing of your personal data is governed by our Privacy Policy and the use of cookies by the Cookie Policy.

9. Changes

We may modify these conditions and the content of the Website at any time. The current version is the one published on this page, with its update date.

10. Governing law and jurisdiction

These conditions are governed by the laws of the Republic of Ecuador. For any dispute, the parties submit to the judges and courts of Quito, without prejudice to the right of consumers resident in Spain or another European Union Member State to bring proceedings before the courts of their domicile where mandatory consumer law so provides.
